DULUTH - Carlton County's attorney pleaded guilty to the charge of a DWI-refusing to submit to a chemical test Tuesday morning.
Forty-eight year old Thom Pertler pleaded guilty to the charge after being pulled over by police in July.
However, six other charges against him were dismissed as part of his plea agreement.
Police say Pertler was swerving into the other lane and speeding before they pulled him over off Highway 61 and 61st Avenue East.
The criminal complaint reports Pertler gave a sample of .32 on a breathalyzer test, which is four times the legal limit, but they weren't able to use it because his breaths were too weak.
Pertler was sentenced to one year in the St. Louis County Jail which he won't have to serve if he completes two years of probation.
As part of his probation he'll have to participate in a victim impact panel, submit to random drug testing, and have no same or similar offenses.
