DULUTH-Duluth city councilor Jay Fosle announced on Saturday his intention to run against State Representative Kerry Gauthier (DFL-Duluth) as a write-in DFL candidate.
Fosle, who is courting the DFL Party for an endorsement, said he expects Gauthier's resignation to come soon.
Duluth police report Gauthier admitted to having oral sex with a 17-year-old boy at the Thompson Hill Rest Area in mid-July.
Whatever Gauthier's decision, however, one thing is clear - he cannot be taken off the ballot.
"Well right now after the primary election, everyone that made it through the primary will be on the ballot," Fosle said. "What really needs to be done is that the citizens need to know how to do write in ballot."
The Republican listed on the ballot is Travis Silvers, according to government records.
DFL leadership says Gauthier was hospitalized earlier this week for an unspecified issue.
Yesterday the Minnesota Speaker of the House called for his resignation.
