DULUTH - OSHA is investigating the death of a man at a Duluth construction site over the weekend.  It happened Saturday at the soon–to–be 'Texas Roadhouse.'

It's a different crew Monday at the 'Texas Roadhouse' construction site at 1101 Mall Drive across from the 'Olive Garden.'  Workers tell FOX 21 they don't Robert B. Gotschall, 31, of Mentor, Ohio, whom 'Roadhouse' representatives say was an out–of–state subcontractor on the painting crew.

"We consider ourselves a family and our thoughts and prayers are with the victim's family," says Roadhouse spokesperson Travis Doster.  "Only thing I do know, I've received no information suggesting it was anything other than an accident."

That accident occurred Saturday night, just after 5:30.

Assistant fire chief Erik Simonson tells us a crew was on scene within three minutes.  When they arrived, they found Gotschall at the bottom of an interior stairwell, down which they assume he had fallen.

"Person was not breathing, not conscious, did not have a pulse," says Erikson.

Performing CPR the entire way, crews rushed Gotschall to St. Mary's Hospital where he died.  OSHA is now investigating.

"Right now we are in the process of conducting interviews with staff, management and staff on site and then we'll be reviewing what type of safety and health practices were occurring at the work site," says OSHA spokesperson Jamer Honerman.
