The City of Duluth is suffering another blow in the legal battle over the Fon-Duluth casino.
Friday, the U.S Court of Appeals changed it’s mind in favor of the Fond Du Lac Band saying the band does not legally owe the City of Duluth more than $10 million in unpaid casino revenue from 2009-2012.
The city says this ruling will be painful with either cutting services or raising taxes.
Meanwhile, one last court hearing is set for later this summer.
That’s the very last shot the city has in the battle with the band.
Meanwhile, Fond Du Lac Chairwoman, Karen Diver, tells Fox 21 “The band is pleased with the ruling which continues to affirm that the payments to the City were illegal. The city’s arguments have been consistently rejected by the courts yet they persist in litigating.”
