Duluth Man Charged with Criminal Vehicular Homicide

A Duluth man has been charged with criminal vehicular homicide after allegedly driving under the influence of heroin and striking and killing a pedestrian. 

27-year-old David Smithson was charged Tuesday with criminal vehicular homicide while operating a vehicle in a negligent manner while under the influence of a controlled substance, and 2nd degree Driving While Impaired. 

Authorities say Smithson allegedly hit 37-year-old Brian Respler on Saturday in West Duluth. 

Police say Respler was crossing a parking lot when he was hit.  

Respler died on scene. 

Bail was set for Smithson at $250,000. 

His next court appearance is scheduled for January 15. 

Meanwhile, Respler leaves behind a wife and four kids.  

A GoFundMe page has been set up to help his family.  Since yesterday, the page has already raised $3,810.
