Mistrial Declared in Itasca County Murder Case

A judge has declared a mistrial in the case against a Deer River man accused of murdering his infant son. 

On Tuesday, the defense made a motion for a mistrial in the case against 38-year-old Emery Jenkins, saying that a witness for the defense was unable to testify due to a medical condition.

The trial began on January 25, and was expected to last a couple of weeks. 

A pre-trial hearing is set for February 22, with a new trial date will be determined at a later date. 

Jenkins is charged with two counts of First Degree Murder and one count of Second Degree Murder in the death of his 2-month-old son. 

An autopsy revealed the baby died as a result of blunt-force trauma.
