Charges: Park Point Burglary Suspect Carried Hammer
There were no injuries reported from the incident
DULUTH, Minn. – Charges say a man entered a stranger’s home on Park Point with a hammer and pliers.
Around 6:20 p.m. on Wednesday, Duluth Police responded to a residence on Minnesota Ave on Park Point for reports of an intruder with a weapon. When officers arrived, they were able to identify the suspect as 42-year-old Brian Adam Burba of Gilbert, MN. The police report said that officers recognized Burba from speaking with him earlier in the day, on Park Point.
Police said when they approached Burba he “had the hammer in his hand as well as pliers and a wood carving belonging to the Victim.” The police report said that while he was taken into custody, Burba made comments to police that “he was doing work on the house and was going to have a “party” there.” Burba complied with officers’ commands to drop the tools and was taken into custody without further incident.
When police spoke with the homeowner, a man in his 70s, he said he was eating on the second floor of the house when he heard a noise. The owner called out and heard a voice respond, “It’s Brian,” and he was there to collect his tools. In the report, the man stated he did not know “anyone named Brian and did not anticipate finding anyone in the home.”
According to the homeowner’s statement, he walked to stairs where he “saw the Defendant three to four stairs down from the top. (He) had a hammer in his hand and a scarf covering his face.” The man warned Burba to leave and that he had a gun, which caused Burba to go back downstairs.
Burba faces two first-degree burglary charges, one for possessing a dangerous weapon and the other for entering an occupied dwelling. Each charge carries a maximum sentence of 20 years.
