Report Finds Probable Cause of Illegal Sexual Discrimination in Hibbing School District

An investigation by the Minnesota Department of Human Rights has determined that a Hibbing School District Administrator engaged in illegal sexual discrimination of students. 

The investigation, however, says the school district failed to respond to complaints from female students who were inappropriately subjected to questioning by a senior administrator about sexual abuse they suffered. 

In August of 2013, the Department received several reports alleging a senior administrator created a sexually hostile environment for female students and disciplined gay students more severely than others.  

The incidents were alleged to have taken place during the 2012-2013 school year. 

After interviewing more than 60 parents, teachers, students and staff, the department found there was sufficient evidence to support allegations of sex-based discrimination. However, the department  found no probable cause of sexual orientation discrimination. 

The Department of Human Rights found the sex-based behavior was “severe and pervasive enough to constitute a hostile environment that interfered with the students’ access to education.” 

According to the report, the administrator discriminated against female students by advising and questioning them on their use of birth control, their sexuality and their dating life.  The administrator disrupted class time by calling female students out of class to have conversations regarding their dating life and others unrelated to his job duties. The department found this was sufficient evidence to support a finding of discrimination by the district.    

As part of an agreement, the Hibbing School District will secure an expert to review it’s policies, and process for ensuring compliance with state and federal laws.  In addition, the district will secure training for the senior administrator, school board, Superintendent, Administrators, faculty and staff on discrimination, appropriate boundaries, and the reporting responsibilities under Minnesota law. 

Minnesota Department of Health Kevin Lindsey will be meeting with parents and community members to answer questions about the case at the Hibbing Coalition for Safe and Accountable School meeting.  The meeting starts at 6:30 p.m. on Monday, February 29 at the Lincoln Elementary School Library.
