Man Suffers Life-Altering Injuries After Rock Attack Near Canal Park; Teen Charged

DULUTH, Minn.– Milton Michael Myschack, 61, of Duluth was randomly attacked with a large rock while walking under an overpass bordering Canal Park, according to his brother, Philip Myschack.

The entire altercation was recorded on a cell phone where you can see a group of teens cornering Myschack before being knocked to the ground with the rock.

“I really believe that they had set the scene up,” said Philip Myshack, who chose to speak to FOX 21 on his brother’s behalf.

The attack happened during the early morning hours of Aug. 26 under the Lake Avenue overpass between the Steam Plant and the city’s electric vehicle charging station.

Nearly a month later, Milton, or “Milty,” as his brother calls him, is still hospitalized and recovering from his head injuries.

“He’s in a mental health part of St. Luke’s because he’s unsafe to be alone or by himself. He’s going to spend the rest of his life in an institution, and he ended up with a lot of mesh work and patches on his skull. And it was terrible. What they did was terrible,” said Myshack.

The accused offender is a 16-year-old male.

“But my understanding from the video and the stuff that the police have talked to me about that Milty was victimized by a young group of people,” said Myshack.

Philip believes the kids set out to do this.

“It’s absolutely sickening what happened, what they did. And this, you could clearly see that in the video that there was intent, because they turned the video on, the kid went right directly to where they had the weapon hid,” explained Myshack.

He’s hoping for justice for his brother, and that the justice system punishes, and rehabilitates the alleged attacker.

“I’d really like to see something good come out of this, if at all possible. You know, I guess that would be my next expectation,” said Myshack.

The 16-year-old suspect is charged with first-degree assault, second-degree assault and two counts of fifth-degree assault.

St. Louis County Attorney Kim Maki told FOX 21 here office will be asking the judge to move the case to adult court at the next hearing set for early October.
