MINNEAPOLIS (CNN) –  The former police officer convicted of murder in the death of George Floyd is seeking a new trial.

Derek Chauvin was found guilty of state and federal charges related to Floyd’s death.

He has served five years of a 22.5 year prison sentence.

Chauvin’s attorney filed court documents asking that three criminal convictions be vacated and a new trial ordered.

The filing accuses prosecutors of misconduct and argues that false testimony from expert witnesses deprived Chauvin of a fair trial.

He was recorded with his knee on Floyd’s neck as Floyd was restrained on the ground — a technique Chauvin claims was part of his officer training.

The recording also captured Floyd saying he could not breathe.

If Chauvin is not granted a new trial, the filing requests that an evidentiary hearing be held to reexamine his case.
